이용약관

2026년 9월 5일 개정: 상품 목록(FIT TURN·TEE Set)과 이용권의 보관 방식(브라우저·로그인 계정·서버 사용 횟수)을 실제 제공 방식에 맞게 수정했습니다.

제1조 (목적)

이 약관은 라라랜드맘(이하 “회사”)이 aifitpix.com(이하 “서비스”)에서 제공하는 AI 가상 피팅 이미지·영상·3D 생성 서비스의 이용조건과 절차, 회사와 이용자의 권리·의무 및 책임사항을 정함을 목적으로 합니다.

제2조 (서비스의 내용과 성격)

회사는 이용자가 업로드한 사진을 인공지능으로 합성하여 가상의 착용 시안을 생성하는 디지털 콘텐츠 서비스를 제공합니다.

제3조 (약관의 효력과 변경)

이 약관은 서비스 화면에 게시함으로써 효력이 발생합니다. 회사는 관련 법령을 위배하지 않는 범위에서 약관을 변경할 수 있으며, 변경 시 적용일자와 변경사유를 명시하여 적용일 7일 전 (이용자에게 불리한 변경은 30일 전)부터 공지합니다.

제4조 (이용계약의 성립과 이용권)

1. 서비스는 회원가입 없이 이용할 수 있으며, 이용자가 상품을 선택하고 결제를 완료하면 이용계약이 성립합니다.
2. FIT Set·FIT Total·FIT Wedding5 등 횟수형 상품은 결제 시 정해진 횟수의 이용권이 부여되며, 생성을 실행할 때마다 1회씩 차감됩니다.
3. 이용권은 이용자의 브라우저 저장소에 보관됩니다. 구글 로그인을 이용한 경우에는 결제번호·상품명·잔여 횟수가 계정에 연결되어 서버에도 보관되며, 다른 기기에서 로그인하면 이어서 사용할 수 있습니다. 로그인하지 않은 이용자가 브라우저 데이터를 삭제하거나 다른 기기·브라우저를 사용하는 경우 잔여 횟수가 조회되지 않을 수 있으므로, 이 경우 결제 정보를 첨부하여 아래 연락처로 문의해 주십시오. 회사는 결제 내역을 확인하여 복구합니다. 결제별 생성 사용 횟수는 부정 이용 방지를 위해 서버에도 기록됩니다.

제5조 (제공 시기)

결제 완료 즉시 생성이 시작되며, 상품별 예상 소요 시간은 다음과 같습니다.

외부 AI 처리 서비스의 대기열 상황에 따라 위 시간이 초과될 수 있으며, 이 경우 화면에 진행 상태를 표시합니다.

제6조 (대금의 결제)

1. 결제는 회사가 지정한 결제대행사(포트원)를 통해 원화(KRW)로 이루어집니다.
2. 회사는 간이과세자로서 세금계산서를 발급하지 않으며, 신용카드 매출전표 또는 현금영수증으로 갈음합니다.
3. 이용자는 결제 전 상품 내용·가격·제공 시기 및 청약철회 제한 사항을 확인할 책임이 있습니다.

제7조 (청약철회 및 환불)

청약철회와 환불에 관한 사항은 환불·청약철회 정책에 따릅니다. 생성이 완료되어 결과물이 제공된 건은 청약철회가 제한되며, 회사는 결제 화면에 이를 표시하고 이용자의 동의를 받은 후 생성을 실행합니다.

제8조 (이용자의 의무 — 사진의 권리)

이용자는 다음 사항을 준수하여야 하며, 위반으로 발생한 분쟁과 손해에 대한 책임은 이용자에게 있습니다.

• 본인의 사진 또는 사용 권한과 초상권 동의를 적법하게 확보한 사진만 업로드할 것
• 타인·공인·연예인의 사진을 동의 없이 사용하지 않을 것
• 미성년자의 사진을 업로드하지 않을 것. 부득이한 경우 법정대리인의 동의를 받아야 합니다.
• 타인의 상표·디자인·저작물을 권한 없이 사용하지 않을 것
• 음란물, 혐오 표현, 명예훼손, 그 밖에 법령에 위반되는 목적으로 서비스를 이용하지 않을 것

회사는 위 사항에 위반되는 것으로 확인된 이용에 대하여 생성을 거절하거나 이용을 제한할 수 있으며, 이 경우 미사용 이용권에 해당하는 금액을 환불합니다.

제9조 (결과물의 권리와 이용 범위)

1. 이용자가 생성한 결과물에 대한 이용 권리는 이용자에게 있습니다. 상업적 이용(상품 상세페이지, 광고 소재 등)도 가능합니다.
2. 다만 결과물에 포함된 제3자의 상표·디자인·초상에 관한 권리는 이전되지 않습니다. 이용자는 게시·광고 전에 해당 권리 관계를 스스로 확인하여야 합니다.
3. 회사는 이용자의 사진이나 결과물을 홍보·광고 목적으로 사용하지 않습니다. 사용이 필요한 경우 별도로 동의를 받습니다.
4. 회사는 이용자의 사진과 결과물을 AI 모델의 학습 데이터로 사용하지 않습니다.

제10조 (회사의 의무와 책임의 한계)

1. 회사는 서비스의 안정적 제공을 위하여 노력합니다.
2. 회사는 인공지능 생성물의 특성상 결과물의 품질·정확도·실물과의 일치를 보증하지 않습니다. 다만 기술적 오류로 결과물이 제공되지 않은 경우에는 재생성 또는 환불로 처리합니다.
3. 회사는 천재지변, 외부 AI 서비스의 장애, 통신 사업자의 장애 등 회사의 통제를 벗어난 사유로 인한 서비스 중단에 대하여 책임을 지지 않습니다. 이 경우 미제공된 결과물에 대한 대금은 환불합니다.
4. 회사는 이용자가 결과물을 사용하여 발생한 제3자와의 분쟁에 대하여 책임을 지지 않습니다.

제11조 (분쟁의 해결)

이 약관에 관한 분쟁은 대한민국 법을 준거법으로 하며, 회사의 주소지를 관할하는 법원을 제1심 관할 법원으로 합니다. 다만 이용자가 소비자인 경우 「민사소송법」상 소비자의 주소지를 관할하는 법원에 소를 제기할 수 있습니다.

분쟁이 원만히 해결되지 않는 경우 한국소비자원(www.kca.go.kr, 국번없이 1372) 또는 전자거래분쟁조정위원회(www.ecmc.or.kr)에 조정을 신청하실 수 있습니다.

Article 1 (Purpose)

These Terms govern the conditions and procedures for using the AI virtual fitting image, video and 3D generation service (the “Service”) provided by Lalalandmam (the “Company”) at aifitpix.com, and set out the rights, obligations and responsibilities of the Company and the user.

Article 2 (The Service and its nature)

The Company provides a digital content service that composites photographs uploaded by the user using artificial intelligence to generate virtual styled images.

Article 3 (Effect and amendment of these Terms)

These Terms take effect upon being posted within the Service. The Company may amend them within the limits of applicable law, and will give notice of the effective date and the reason for the amendment at least 7 days in advance (30 days where the change is unfavourable to users).

Article 4 (Formation of contract and credits)

1. The Service may be used without registration. A contract is formed when the user selects a product and completes payment.
2. For credit-based products such as FIT Set, FIT Total and FIT Wedding5, the stated number of credits is granted at payment and one credit is deducted per generation.
3. Credits are stored in the user's browser storage. Where Google sign-in is used, the payment number, product name and remaining uses are also stored on the server linked to the account, and can be continued after signing in on another device. If a user who is not signed in clears browser data or switches device or browser, the remaining balance may not be found. In that case, please contact us with your payment details and we will verify the transaction and restore the balance. Per-payment generation counts are also recorded on the server to prevent misuse.

Article 5 (Time of supply)

Generation begins immediately upon payment. Expected processing times are:

These times may be exceeded depending on the queue at external AI processing providers; progress is shown on screen in that case.

Article 6 (Payment)

1. Payment is processed in Korean won (KRW) through the payment provider designated by the Company (PortOne).
2. The Company is a simplified taxpayer and does not issue tax invoices; a credit card sales slip or cash receipt is provided instead.
3. The user is responsible for reviewing the product description, price, delivery time and any restriction on withdrawal before paying.

Article 7 (Withdrawal and refunds)

Withdrawal and refunds are governed by the Refund & Withdrawal Policy. Withdrawal is restricted once generation is complete and the output has been provided; the Company displays this on the payment screen and obtains the user's consent before running generation.

Article 8 (User obligations — rights in photographs)

The user must comply with the following. Responsibility for disputes and losses arising from a breach rests with the user.

• Upload only your own photographs, or photographs for which you have lawfully secured usage rights and portrait consent
• Do not use photographs of other people or public figures without their consent
• Do not upload photographs of minors. Where unavoidable, the consent of a legal guardian is required.
• Do not use third-party trade marks, designs or copyrighted works without authorisation
• Do not use the Service for obscene material, hate speech, defamation or any other unlawful purpose

The Company may refuse generation or restrict use where a breach is identified, and will refund the amount corresponding to any unused credits.

Article 9 (Rights in the output and permitted use)

1. Rights to use the output belong to the user, including commercial use such as product pages and advertising material.
2. However, rights in third-party trade marks, designs or likenesses appearing in the output are not transferred. The user must verify those rights before publishing or advertising.
3. The Company does not use the user's photographs or output for promotional or advertising purposes. Separate consent is obtained where such use is required.
4. The Company does not use the user's photographs or output as training data for AI models.

Article 10 (Company obligations and limits of liability)

1. The Company will endeavour to provide the Service reliably.
2. Given the nature of AI-generated material, the Company does not warrant the quality or accuracy of the output, or that it matches the physical product. Where the output is not delivered due to a technical fault, the Company will regenerate it or issue a refund.
3. The Company is not liable for interruptions caused by events beyond its control, including natural disasters and outages at external AI or telecommunications providers. Amounts paid for undelivered output are refunded.
4. The Company is not liable for disputes with third parties arising from the user's use of the output.

Article 11 (Governing law and jurisdiction)

These Terms are governed by the laws of the Republic of Korea, and the court having jurisdiction over the Company's address shall be the court of first instance. Where the user is a consumer, an action may be brought in the court having jurisdiction over the consumer's address under the Civil Procedure Act.

Where a dispute is not resolved amicably, application may be made to the Korea Consumer Agency (www.kca.go.kr, 1372) or the E-Commerce Dispute Mediation Committee (www.ecmc.or.kr).
